Restructuring and Insolvency

Advice on refinancing and corporate restructuring, pre-insolvency and insolvency proceedings, insolvency administration and the second-chance (debt relief) mechanism.

Restructuring Services

In times of economic uncertainty, organisations may run into financial difficulties. EGALTIA has restructuring experts who work alongside the management of organisations undergoing restructuring and refinancing processes. We act for financial institutions, companies and investors alike, making our specialists available to them.

The aim of this practice is to add value to businesses whose margins are at or below expectations by analysing their business, identifying their needs and recommending appropriate solutions to mitigate the impact of the crisis on the organisation.

EGALTIA offers you a team of professionals with extensive experience in refinancing and corporate restructuring to advise you on:

  • Strategic, operational and financial resizing.
  • Preparing business and viability plans that analyse the current and future financial position, providing assurance both to the organisation and to the third parties involved in the negotiations or agreements to be reached.
  • Renegotiating debt with financial institutions and arranging new financing.
  • Improving performance and working capital by monitoring and controlling the implementation of a strategic, operational and financial plan.

Our services in this area include, among others:

  • Independent business review.
  • Reorganisation and restructuring.
  • Strategic exit plans, and the liquidation and dissolution of companies.
  • Advice in insolvency and pre-insolvency situations.

The restructuring practice advises all stakeholders of an organisation (shareholders, managers, creditors, regulators, employees, etc.) that is in financial difficulty or going through a crisis, by analysing the situation and identifying and planning restructuring measures or processes that secure its continuity.

Pre-insolvency and Insolvency Services

EGALTIA has an insolvency practice made up of a multidisciplinary team of insolvency lawyers and economists who, in coordination with the firm's other practice areas, advise all parties involved in insolvency proceedings (concurso de acreedores) — the company, the business owner, creditors, employees and public authorities — whether in the context of business continuity and restructuring, the insolvency proceedings themselves or liquidation.

EGALTIA's professionals also act as accredited insolvency practitioners (administradores concursales), appointed by various courts across Spain.

Our main areas of practice are:

  • Insolvency administration.
  • Pre-insolvency and insolvency law.
  • Debt refinancing.
  • Business liquidation plans.
  • Insolvency proceedings (for creditors and debtors).
  • Insolvency arbitration and mediation.

Second-Chance Law

At EGALTIA we advise and assist individuals and self-employed business owners whose level of debt is leading them into a critical situation. This scenario is addressed by Law 25/2015 of 28 July on the second-chance (debt relief) mechanism, reduction of the financial burden and other social measures, which created a mechanism allowing debts to be restructured (and, where applicable, discharged), striking a balance between creditors and debtors. To access the benefits of this Law, EGALTIA has highly specialised multidisciplinary professionals to advise on and conduct the out-of-court and court proceedings involved.
